Article 319. Actions of the court on the received criminal case CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. When a criminal case is brought to court, the chairman of the court or another judge, on his behalf, resolves the issue of accepting the case for trial.
2. The judge of the received case makes one of the following decisions on:
1) the appointment of the main trial in a general or abbreviated manner;
2) conducting a preliminary hearing of the case.
3. The judge makes a decision on the case in the form of a resolution, which must specify:
1) the time and place of the ruling;
2) the position and surname of the judge who issued the ruling;
3) the grounds and substance of the decisions taken.
4. The decision must be made no later than five days after the case is submitted to the court.
5. At the same time as issuing the decision, the judge is obliged to consider the question of the validity of the application or non-application of a preventive measure to the accused and the validity or unreasonableness of its type, if the preventive measure is chosen, to extend the period of application of the preventive measure if it has expired by that time.
