Article 35. Quality of communication services Chapter 8. Rights of users of communication services of the Law on Communications

     1. Telecom operators are required to provide users with communication services that comply in quality with standardization documents, technical standards, quality indicators of communication services, and the terms of the contract for the provision of communication services.

     1-1. Standards that ensure the technical compatibility of telecommunications networks and facilities, indicators of the quality of communication services, and the size of billing units are approved by the authorized body.

     2. Communication services are provided on equal terms to all categories of users (population, budget organizations, business entities) in accordance with the rules for the provision of communication services, taking into account the benefits and advantages in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

The mobile operator is obliged to issue, at the request of the subscriber, no more than ten subscriber numbers sufficient for personal, family and other use.

     The mobile operator issues more than ten subscriber numbers to the subscriber when providing the mobile operator with appropriate justifications, evidence of necessity, indicating the description and identification codes of subscriber devices, including machine-to-machine communication devices in which subscriber numbers will be used, in accordance with the procedure determined by the rules for the provision of communication services.

     It is prohibited to conclude a contract for the provision of cellular communication services with a cellular subscriber without biometric identification by comparing the current image of the identified person and the reference image of the person from the reference database of biometric data.

     When registering a subscriber number by individual entrepreneurs and legal entities, it is mandatory for their employees to undergo biometric identification, to whom the subscriber numbers are transferred for use, within no more than ten working days from the date of submitting an application for registration of a subscriber number.

The Law of the Republic of Kazakhstan dated July 5, 2004 No. 567.

     This Law establishes the legal basis for activities in the field of communications in the territory of the Republic of Kazakhstan, defines the powers of state bodies to regulate these activities, the rights and obligations of individuals and legal entities providing or using communications services.
