Article 36-1. Transfer of a subscriber number in cellular networks of the Communications Act

  1. The transfer of the subscriber's number for the subscriber is carried out free of charge.

      The subscriber has the right to save and use the subscriber number when entering into a new contract for the provision of cellular communication services with another cellular operator.  

     2. Cellular operators are required to ensure the transfer of subscriber numbers in cellular networks in accordance with the legislation of the Republic of Kazakhstan in the field of communications.

      3. When transferring subscriber numbers, cellular operators interact exclusively through a centralized database of subscriber numbers.  

     4. The procedure for the functioning of a centralized database of subscriber numbers and the provision of access to its resources, as well as organizational and technical interaction and mutual settlements between participants in the transfer of subscriber numbers is determined by the rules for the transfer of subscriber numbers in cellular networks.

      5. Cellular operators are required to ensure that the operator of a centralized database of subscriber numbers is provided with information about cellular subscriber numbers, including information determined by the rules for transferring a subscriber number in cellular networks.  

     6. Telecom operators independently bear all costs (for network modernization, digital systems and software, interaction with a centralized database of subscriber numbers) to ensure the transfer of a subscriber number in their own networks and the ability to access the resources of a centralized database of subscriber numbers.

     7. Cellular operators pay for the services of the operator of a centralized subscriber number database for providing access to its resources in accordance with the procedure determined by the rules for transferring a subscriber number in cellular networks.

     8. The subscriber submits an application for the transfer of the subscriber number to the mobile operator to whose network he is switching, with the subsequent conclusion of the contract.

     9. The transfer of subscriber numbers in cellular networks is carried out by cellular operators on time and under the conditions defined by the rules for the transfer of subscriber numbers in cellular networks.

     10. Cellular operators have no right to prevent the transfer of cellular subscribers to another cellular operator.

     This Law establishes the legal basis for activities in the field of communications in the territory of the Republic of Kazakhstan, defines the powers of state bodies to regulate these activities, the rights and obligations of individuals and legal entities providing or using communications services.
