1. For the state registration of a condominium object, a written application is submitted to the registration authority from at least two owners of apartments, non-residential premises, parking spaces, storerooms of an apartment building, the chairman of the association of property owners of an apartment building, or a statement from a local executive body, or a statement from the customer (developer) of an apartment building.

During the state registration of a condominium facility, the registering authority enters information into the legal cadastre in accordance with the Law of the Republic of Kazakhstan "On Housing Relations".

2. The state registration of a condominium facility may be carried out on the basis of an electronic application submitted via the Internet, in accordance with the procedure determined by the authorized body.

3. If at the time of the state registration of the condominium object in the legal cadastre there is no information about the registration of the right to a land plot, the registering authority enters information about the land plot from the automated information system of the state land cadastre.

In the absence of information about the land plot in the information system of the state land cadastre, the registering authority sends a notification to the local executive body on registration of rights to the land plot in accordance with the legislation of the Republic of Kazakhstan.

4. Changes in the composition of the common property of a condominium object and (or) the size of the shares of owners of apartments, non-residential premises, parking spaces, storerooms in the common property of a condominium object are subject to state registration as a result of changes in the usable area of apartments and non-residential areas of an apartment building.

5. The procedure for state registration of a condominium facility is determined by the authorized body.

This Law defines the goals, objectives and legal framework in the field of state registration of rights to immovable property.
