Article 40. Technological standards of the Environmental Code of the Republic of Kazakhstan
1. Technological standards in this Code are understood as environmental standards established in a comprehensive environmental permit in the form of:
1) the maximum quantity (mass) marker pollutants per unit volume of emissions;
2) the amount of consumption of electric and (or) thermal energy, other resources per unit of time or unit of manufactured products (goods), work performed, services rendered.
Marker pollutants are the pollutants that are most significant for the emissions of a particular type of production or technological process, which are selected from a group of pollutants characteristic of such production or technological process and with the help of which it is possible to estimate the emission values of all pollutants included in the group.
Marker pollutants, levels of emissions of marker pollutants, and levels of energy and/or other resource consumption associated with the use of the best available techniques are determined in the conclusions on the best available techniques.
2. Technological standards include:
1) Technological emission standards;
2) technological standards of discharges;
3) technological specific standards of water consumption;
4) technological specific standards of heat and (or) electric energy consumption.
3. Technological standards are established in a comprehensive environmental permit and should not exceed the relevant technological indicators (if any) related to the use of the best available techniques in specific areas of their application, established in the conclusions on the best available techniques.
4. The justification of technological standards is provided in the draft technological standards submitted to the authorized body in the field of environmental protection by the operator of the facility together with an application for a comprehensive environmental permit.
