Article 402. Interaction between customs authorities and other state bodies of the Republic of Kazakhstan exercising state control (supervision) at the customs border of the Eurasian Economic Union Code on Customs Regulation in the Republic of Kazakhstan

Article 402. Interaction between customs authorities and other state bodies of the Republic of Kazakhstan exercising state control (supervision) at the customs border of the Eurasian Economic Union Code on Customs Regulation in the Republic of Kazakhstan

     1. When carrying out customs control in respect of goods transported across the customs border of the Eurasian Economic Union and subject to control by other state bodies of the Republic of Kazakhstan exercising state control (supervision) at the customs border of the Eurasian Economic Union, the customs authorities ensure general coordination of actions of other controlling state bodies of the Republic of Kazakhstan and simultaneous joint control in accordance with the procedure determined by a joint act.

     2. Customs authorities and other state bodies of the Republic of Kazakhstan exercising state control (supervision) at the customs border of the Eurasian Economic Union shall exchange documents and (or) information (information) necessary for conducting customs and other types of state control (supervision) using information systems.

     3. In order to speed up state control (supervision) when moving goods across the customs border of the Eurasian Economic Union, customs inspection may be carried out with the participation of other state bodies of the Republic of Kazakhstan that exercise state control (supervision) at the customs border of the Eurasian Economic Union. At the same time, a customs inspection report is drawn up.

     4. Radiation control is the verification of the level of ionizing radiation emanating from goods and (or) vehicles transported across the customs border of the Eurasian Economic Union, and comparing it with the natural background in order to ensure safety for the public and the environment.

     Radiation control is carried out by customs authorities located at checkpoints and other places of movement of goods and vehicles across the customs border of the Eurasian Economic Union, using technical means of radiation control in automatic or manual mode.

     The procedure for conducting radiation monitoring is determined by the authorized body in coordination with the relevant authorized state bodies.

     5. The customs authorities carry out customs control over goods subject to the control of specific goods when moving these goods across the customs border of the Eurasian Economic Union.

     The customs authorities prevent and suppress the illegal movement of goods across the customs border of the Eurasian Economic Union that are subject to the control of specific goods.

     6. State veterinary and sanitary control and supervision at automobile checkpoints across the customs border of the Eurasian Economic Union are carried out in order to verify compliance with the requirements of the legislation of the Republic of Kazakhstan in the field of veterinary medicine and are aimed at protecting the customs territory of the Eurasian Economic Union from the introduction and spread of pathogens of infectious and exotic animal diseases from other states that are not members of the Eurasian Economic Union.

     State veterinary and sanitary control and supervision at automobile checkpoints across the customs border of the Eurasian Economic Union are carried out by state veterinary and sanitary inspectors of the department of the authorized body in the field of veterinary medicine.

     7. State quarantine phytosanitary control and supervision at automobile checkpoints across the customs border of the Eurasian Economic Union are carried out in order to verify compliance with the requirements of the legislation of the Republic of Kazakhstan in the field of plant quarantine and are aimed at protecting the customs territory of the Eurasian Economic Union from introduction or independent entry from other states that are not members of the Eurasian Economic Union, quarantine facilities.

     State quarantine phytosanitary control and supervision at automobile checkpoints across the customs border of the Eurasian Economic Union are carried out by state plant quarantine inspectors of the department of the authorized body in the field of plant quarantine.

     8. Sanitary quarantine control is the control over the sanitary and epidemiological condition of goods (cargoes) and the state of human health during the movement of people and goods (cargoes) across the customs border of the Eurasian Economic Union, carried out in order to prevent the importation into the customs territory of the Eurasian Economic Union of infectious and parasitic diseases, as well as potentially dangerous substances to human health and products.

     Sanitary and quarantine control at automobile checkpoints across the customs border of the Eurasian Economic Union is carried out by customs officials in accordance with the procedure established by a joint act of the authorized body and the state body in the field of sanitary and epidemiological welfare of the population.

     In the event of a real threat of the import of infectious and parasitic diseases, as well as substances and products potentially dangerous to human health from other states that are not members of the Eurasian Economic Union, customs authorities, in order to carry out sanitary and quarantine control, involve territorial authorities in the field of sanitary and epidemiological welfare of the population in accordance with the procedure established by a joint act of the authorized body and the state body in the field of sanitary and epidemiological welfare of the population.

     9. Transport control assigned to customs authorities at automobile, sea checkpoints and other places of movement of goods across the customs border of the Eurasian Economic Union, including at the places of delivery of goods, upon completion of the customs procedure of customs transit, is carried out in order to verify compliance by individuals and legal entities with the requirements of the legislation of the Republic of Kazakhstan in the field of motor transport.

     Transport control assigned to customs authorities at automobile, sea checkpoints and other places of movement of goods across the customs border of the Eurasian Economic Union is carried out by customs officials in accordance with the procedure established by a joint act of the authorized body and the authorized body in the field of transport.
