Article 41. Official land allotment of the Land Code of the Republic of Kazakhstan

     1. Service land allotment is a special type of temporary long-term gratuitous land use.  

     2. The list of categories of employees entitled to official land is established by the Government of the Republic of Kazakhstan.

     3. The service land allotment is allocated from the lands in the land use of the state legal entities where the persons having the right to allotment work.  

     4. An office land allotment is provided for the maintenance of an office dwelling house, cultivation of agricultural crops, haymaking, cattle grazing, as well as the placement of apiaries.  

     5. The service land allotment belongs to the secondary temporary gratuitous land use and is provided for the period of work in connection with which it is allocated. In the event that crops are sown on an official land allotment, the right to use the official land allotment by a dismissed employee is terminated after harvesting.  

     6. The official land allotment remains:  

     1) for employees who have terminated their employment relationship after retirement due to age or disability;  

     2) for the families of employees who have been called up for active military service in the Armed Forces or enrolled in studies, for the entire period of these employees' active service or in an educational institution;

     3) for the families of employees who died in connection with the performance of their official duties: for a disabled spouse and elderly parents - for life, for children - until they reach adulthood.  

     7. The right to an official land allotment in the form of a plot for the maintenance of an official residential building remains insofar as, in accordance with the housing legislation of the Republic of Kazakhstan, the right to live in an official residential building remains.  

     8. The provision of a land plot in the order of an official land allotment is carried out on the basis of an agreement on the provision of an official land allotment concluded between an employee and the administration of a legal entity.  

     9. It is not allowed to make any transactions with respect to the right of land use of an official land allotment.
