Article 421. Refusal of a witness or victim to testify in the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
Refusal of a witness or victim to testify in court or during a pre-trial investigation –
is punishable by a fine in the amount of two thousand to five thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand two hundred hours, or restriction of liberty for up to five years, or imprisonment for the same term.
Note. A person is not subject to criminal liability for refusing to testify against himself, his spouse or his close relatives, as well as clergymen for refusing to testify against those who confided in them in confession, mediators against persons and circumstances that became known to them in connection with mediation, participants in the national preventive mechanism against individuals and the circumstances that became known to them from conversations with persons held in special institutions that provide temporary isolation from society.
