Article 43-1. Activities and competencies of organizations of higher and (or) postgraduate education The Law on Education
1. Organizations of higher and (or) postgraduate education have the right to carry out the following types of activities at the expense of extra-budgetary sources of financing:
1) training of personnel in educational programs of higher and postgraduate education, as well as scientific, technical, innovative activities, scientific research, including fundamental and applied scientific research;
2) providing students with meals, accommodation, and medical care;
3) providing employees with food, accommodation, and medical care;
4) ensuring the safety of students;
5) organization and holding of sports and cultural events;
6) organization and holding of physical culture and recreation events, creation of sports and creative sections;
7) publishing and printing activities to ensure the educational process, research, educational and socio-cultural activities;
8) organization and participation in various events at the international and national levels: Olympiads, competitions, contests, conferences, seminars among students and teachers;
9) preparation of students for military service according to the programs of reserve officers and sergeants of the reserve;
10) implementation of general education curricula for primary, basic secondary and general secondary education, as well as educational programs for technical and vocational, post-secondary, and additional education;
11) creation of technopolises, technoparks, business incubators, innovation centers, centers for commercialization and technology transfer, design bureaus and other structures in the field of activity;
12) participation in the development, testing and implementation of innovative teaching methods, technologies and research aimed at further development and improvement of the education and science system;
13) organization, creation and development of digital interactive educational resources and educational films for all levels of education;
14) participation in the integration of education and science with production;
15) organization and financing of development, innovation and investment projects involving financial resources from subsidiaries and other organizations of the Republic of Kazakhstan and foreign organizations, as well as participation in the formation of mechanisms and infrastructure for venture financing projects in the field of education and science;
16) other types of activities not prohibited by the laws of the Republic of Kazakhstan.
Organizations of higher and (or) postgraduate education, more than fifty percent of whose shares belong to the state, and persons affiliated with them, along with the types of activities specified in part one of this paragraph, are entitled to carry out other types of activities provided for in the list of types of activities carried out by legal entities, more than fifty percent of whose shares (shares in the authorized capital) belong to the state, and persons affiliated with them, approved by the Government of the Republic of Kazakhstan.
2. The competence of organizations of higher and (or) postgraduate education includes:
1) development and approval of educational programs for higher and postgraduate education in accordance with state mandatory education standards;
2) determination of qualification characteristics of positions of employees of organizations of higher and (or) postgraduate education in accordance with the legislation of the Republic of Kazakhstan;
3) development and approval of the rules for competitive replacement of positions of teaching staff and researchers;
4) development and approval of the forms of an educational services agreement and a professional practice agreement;
5) implementation of educational activities based on independently developed standards of workload, forms and amounts of remuneration;
6) development and approval of the rules of admission to the organization of higher and (or) postgraduate education;
7) development of a program for the development of higher and (or) postgraduate education;
8) awarding of Bachelor's and Master's degrees to students;
9) development and approval of rules for the organization and conduct of professional practice and rules for the definition of organizations as bases of practice;
10) development and approval of rules for the transfer and reinstatement of students in accordance with the standard rules of higher and (or) postgraduate education organizations;
11) granting academic leave to students based on the conclusion of the medical advisory commission, the summons for military service, the birth, adoption of a child before the age of three years;
12) development and approval of internal regulations;
13) development and approval of work curricula and work curricula;
14) introduction of new learning technologies, including credit learning technologies;
15) conducting ongoing monitoring of academic performance, intermediate and final attestation of students in accordance with the standard rules of higher and (or) postgraduate education organizations;
16) provision of advanced training and retraining of personnel in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
17) financial, economic and logistical support, including the provision of equipment;
18) introduction of modern forms of professional training;
19) presentation of financial statements in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
3. Organizations of higher and (or) postgraduate education have the right, in accordance with the legislation of the Republic of Kazakhstan:
1) to form and (or) replenish an endowment fund (endowment capital), including through the establishment of an endowment fund;
2) create legal entities for scientific and educational activities at the expense of extra-budgetary sources of financing;
3) open startup companies;
4) to attract additional sources of financial and material resources for the implementation of statutory activities;
5) establish branches in foreign countries.
4. Organizations of higher and (or) postgraduate education having a special status also have the right:
1) independently determine the content of higher and postgraduate education not lower than the requirements of the relevant state mandatory education standards;
2) to award the degrees of Doctor of Philosophy (PhD) and Doctor of profile in accordance with the procedure determined by the authorized body in the field of education.
Organizations of higher and (or) postgraduate education in the organizational and legal form of state institutions have the right to carry out the types of activities provided for in the first part of paragraph 1 of this article, including at the expense of budgetary funds in accordance with the legislation of the Republic of Kazakhstan, with the exception of the norms provided for in the subparagraphs 3), 6), 7), 9), 11), 13), 14) and 15) of the first part of paragraph 1 of this Article for organizations of higher and (or) postgraduate education in the field of culture in the organizational and legal form of state institutions.
The competence of organizations of higher and (or) postgraduate education provided for in the sub-paragraphs 2), 3), 6), 9), 10), 11) and 15) of paragraph 2 of this article, does not apply to the Academy of Justice, military, special educational institutions.
