Article 43. Connection of criminal cases CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. Criminal cases may be combined in one proceeding against several persons who have committed one or more criminal offenses in complicity, cases against a person who has committed several criminal offenses, as well as cases against a person suspected or accused of previously not promising to conceal the same crimes or not reporting them.
Criminal cases involving related offences of taking a bribe, giving a bribe, mediation in bribery or commercial bribery may also be combined in one proceeding.
2. The combination of criminal cases is also allowed in cases where the suspect has not been identified, but there are sufficient grounds to believe that several criminal offenses were committed by one person or a group of persons.
3. The connection of criminal cases is carried out on the basis of a resolution of the body conducting the criminal process. A copy of the decision issued by the criminal prosecution authority is sent to the prosecutor and the defense within twenty-four hours.
4. They should not be combined in the same production:
1) the same suspicions and accusations against different persons;
2) suspicions and accusations against persons who are attributed to the commission of criminal offenses against each other, except in cases where a private prosecution case is being considered.;
3) cases in which criminal prosecution is carried out privately, and in the other – in a public manner.;
4) all other suspicions, accusations, the joint consideration of which may interfere with the objective consideration of the case.
5. Excluded by the Law of the Republic of Kazakhstan dated 07/16/2025 No. 210-VIII (effective sixty calendar days after the date of its first official publication).
6. Persons have the rights of participants in criminal proceedings only in those combined cases that relate to them.
