1. State bodies exercising state architectural and construction control and supervision:

1) the executive body for architecture, urban planning and supervision, which carries out state architectural and construction control and supervision over the activities of local executive bodies for architecture, urban planning, construction and state architectural and construction control and supervision;

2) the local executive body of capitals, regions, cities of republican significance, which carries out state architectural and construction control and supervision over compliance by subjects (objects) of control and supervision with the requirements of the legislation of the Republic of Kazakhstan On architectural, urban planning and construction activities.

2. State architectural and construction control (hereinafter referred to as control for this article) is carried out in the form of inspection and prevention of the subject (object) of control and supervision in accordance with the Business Code of the Republic of Kazakhstan.

Preventive control without establishing the subject (object) of control and supervision is carried out in accordance with the Business Code of the Republic of Kazakhstan and this Code.

3. Subjects (objects) of control and control are:

1) local executive bodies for architecture, urban planning, construction and state architectural and construction control and supervision;

2) individuals and legal entities subject to the requirements of the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities.

4. The state architectural and construction control and supervision are responsible for:

1) monitoring of construction sites under construction (reconstructed, expanded, modernized, overhauled) and put into operation;

2) implementation of measures established by the legislation of the Republic of Kazakhstan with respect to subjects of control and supervision that violate the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities or do not limit their violations based on the results of state architectural and construction control and supervision;

3) exercising control and supervision over the activities of the subject (object) of control and supervision;

4) informing local executive bodies on architecture, urban planning and construction, state expert organizations and (or) expert organizations no later than three working days on the declared unauthorized or illegal construction (introduced) facilities;

The state body responsible for state regulation and control of activities in the field of state registration of rights to immovable property and state maintenance of immovable property is obliged to impose an encumbrance on immovable property in the legal cadastre from the moment of receiving information from the State architectural and construction control and supervision.

The basis for lifting the ban on real estate is the approval of the state body responsible for state architectural and construction control and supervision on the elimination of identified violations.

5. State architectural and construction control and supervision by the local executive body of the capital, region, city of republican significance, which carries out state architectural and construction control and supervision, should not subordinate the facilities specified in paragraph 4 of Article 98 of this Code, except for conducting unscheduled inspections.
