Article 47. Reorganization of the voluntary accumulative Pension Fund of the Social Code of the Republic of Kazakhstan
1. The reorganization of the voluntary accumulative pension fund is carried out by a decision of the general meeting of shareholders with the permission of the authorized body for regulation, control and supervision of the financial market and financial organizations in the form of affiliation. The conditions and procedure for granting permission to reorganize a voluntary accumulative pension fund are established by regulatory legal acts of the authorized body for regulation, control and supervision of the financial market and financial organizations.
The specifics of reorganizing a voluntary accumulative pension fund with the participation of the state, the national welfare fund and (or) an authorized body are determined by a regulatory legal act of the authorized body for regulation, control and supervision of the financial market and financial organizations.
2. A reorganized voluntary accumulative pension fund has the right to attract voluntary pension contributions and make pension payments based on a license from a voluntary accumulative pension fund that has joined another voluntary accumulative pension fund.
3. Pension assets and liabilities of the affiliated voluntary accumulative pension fund under agreements on pension provision at the expense of voluntary pension contributions are subject to transfer to the reorganized voluntary accumulative pension fund in accordance with the procedure established by a regulatory legal act of the authorized body for regulation, control and supervision of the financial market and financial organizations.
