1. Biometric data used for digital authentication is recognized as personal data and is subject to protection in accordance with the Law of the Republic of Kazakhstan "On Personal Data and their Protection".

2. Every citizen of the Republic of Kazakhstan has the right to biometric registration for digital authentication purposes.

3. Mandatory processing of biometric data and biometric authentication are allowed only in cases established by the laws of the Republic of Kazakhstan.

4. Biometric authentication is the process of comparing and verifying the compliance of biometric data for the purpose of identification.

5. Biometric authentication provided for by the laws of the Republic of Kazakhstan is carried out using the national biometric authentication system when digitizing the activities of a government agency, including the implementation of government functions and the provision of public services in accordance with the rules of operation and connection to the national biometric authentication system approved by the authorized body, unless otherwise provided by paragraph 6 of this Article.

6. The procedure for biometric authentication by financial and payment organizations, including cases of mandatory use and (or) filling with biometric data of the national biometric authentication system obtained by the identification data exchange center of the National Bank of the Republic of Kazakhstan, is determined by the authorized body for regulation, control and supervision of the financial market and financial organizations and the National Bank of the Republic of Kazakhstan.

7. The national biometric authentication system is a digital object of the "digital government" designed for face-based biometric authentication, the creation, development, maintenance and system maintenance of which is carried out by the operator.

8. This article does not apply to relations arising from the collection, processing and protection of biometric data in the course of intelligence, counterintelligence, operational search activities, as well as the implementation of security measures to ensure the safety of protected persons and facilities.
