The expulsion of a foreigner or a stateless person from the Republic of Kazakhstan is enforced with the establishment of a ban on the entry of this person into the territory of the Republic of Kazakhstan for a period of five years.
The expulsion of a foreigner or a stateless person from the Republic of Kazakhstan for committing a crime may be imposed as an additional type of punishment, and for committing a criminal offense – as both the main and additional type of punishment.
When a court appoints this type of punishment as an additional one, it is executed after serving the main type of punishment or being released from further serving it on the grounds provided for in subparagraphs 3), 5), 6) and 7) of the first part of Article 161 of the Criminal Executive Code of the Republic of Kazakhstan, and in cases of application of a suspended sentence - from the date of entry into force of the sentence. into legal force.
