1. Copyright support is provided by the author(s) of construction projects at all construction sites, with the exception of those specified in paragraph 1 of Article 133 of this Code.

2. The author's support carried out during construction is carried out in accordance with the rules for the provision of engineering services in architectural, urban planning and construction activities, approved by the authorized body for architecture, Urban Planning and construction, and on the basis of a contract.

Author's support is mandatory throughout the entire period of construction (reconstruction, restoration, expansion, technical re-equipment, modernization, capital repairs) of a construction facility or its conservation at the expense of funds provided for in the design and estimate documentation in accordance with state regulatory documents.

Upon completion of the construction, the person providing the author's support issues to the customer an opinion on the compliance of the completed works with the approved construction project.

3. The author(s) of the construction project have the right to delegate the author's supervision of the construction:

1) a specialist (employee) who has a certificate for the right to provide engineering services;

2) to the customer for self-selection of a supplier of engineering services for the implementation of author's support, which has the appropriate certificate for the right to provide engineering services.

4. Persons providing copyright support have the right to:

1) free access to the relevant construction site under construction;

2) to get acquainted with the documentation related to the construction site under construction;

3) require the customer and the contractor (general contractor) to strictly comply with the design decisions provided for by the approved construction project, as well as the requirements of the legislation of the Republic of Kazakhstan and state regulatory documents;

4) issue written instructions on the mandatory elimination by the customer, contractor (general contractor) of violations of state regulatory documents and (or) deviations from design decisions provided for by the approved construction project.

5. Persons providing copyright support are obliged to:

1) to ensure control over the exact execution during construction of design decisions provided for by the approved construction project;

2) to carry out regular and proper maintenance of the journal of the author's support;

3) to monitor the execution of their instructions entered in the journal of the author's support;

4) participate in the registration and signing of certificates of inspection of the main types of hidden work and intermediate acceptance of critical structures in accordance with the requirements of state regulatory documents;

5) to make timely decisions on making reasonable changes to the approved construction project in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

6) in case of non-fulfillment or improper fulfillment by the contractor (general contractor) of the instructions, inform the customer or his authorized person about this, as well as inform the relevant local executive body responsible for state architectural and construction control and supervision.;

7) to fill out appendices to the act of acceptance of the construction site into operation;

8) submit the construction project to the relevant local executive body responsible for state architectural and construction control and supervision, as well as the expert opinion on the relevant construction projects.

This Code regulates public relations related to the implementation of architectural, urban planning and construction activities in the Republic of Kazakhstan, the formation of a full-fledged habitat and human activity, planning and development of settlements, interuniverse territories, ensuring the safety of construction sites at all stages of their life cycle.
