Article 54. Technical supervision of the Construction Code of the Republic of Kazakhstan
1. Technical supervision is mandatory at all construction sites, with the exception of those specified in Article 121 and paragraph 1 of Article 133 of this Code, in accordance with the rules for the provision of engineering services in architectural, urban planning and construction activities, approved by the authorized body for architecture, urban Planning and construction.
Upon completion of the construction of a construction facility, the persons carrying out technical supervision issue to the customer an opinion on the quality of construction and installation works, agreed with the local executive body of the region, the city of republican significance, the capital, which carries out state architectural and construction control and supervision.
In case of failure to submit a schedule for visiting a construction site, the customer provides the local executive body responsible for state architectural and construction control and supervision with access to the construction site to establish the readiness of the construction site for operation.
2. Technical supervision is carried out by the customer independently or with the involvement of an accredited legal entity or a specialist certified for the provision of engineering services for technical supervision, at the expense of funds provided by the construction project.
3. Administrators of budget programs (customers) have the right to involve specialists operating in the market who have the appropriate certificate for the provision of engineering services in order to carry out technical supervision over the implementation of construction projects financed by public investments.
4. Persons exercising technical supervision have the right to:
1) free access to the relevant construction site under construction;
2) to get acquainted with the documentation related to the construction site under construction;
3) require the contractor (general contractor) to strictly comply with the design decisions and calculations provided for by the approved construction project, as well as the requirements of organizational and technological documents defining the technological process of construction and installation work;
4) issue written instructions on the mandatory elimination by the contractor (general contractor) of violations of state (interstate) regulatory documents committed by him during construction, deviations from design decisions provided for by the approved construction project, and (or) requirements of organizational and technological documents with the right to suspend construction and installation work in order to comply with the instructions within the prescribed time;
5) if necessary, when accepting completed works for payment, carry out a test by an accredited testing laboratory (center) on the right of ownership or lease of the quality of construction and installation works performed, their volumes, materials used, products, structures and equipment.
5. Persons carrying out technical supervision are obliged to:
1) ensure supervision of the contractor's (general contractor's) compliance with the requirements of state (interstate) regulatory documents, organizational and technological documents defining the technological process of construction and installation work;
2) ensure high-quality construction and installation work on a daily (continuous) basis;
3) to carry out regular and proper maintenance of the technical supervision log;
4) participate in the registration and signing of certificates of inspection of hidden works and intermediate acceptance of responsible structures in accordance with the requirements of state regulatory documents;
5) submit a monthly report on the state and progress of construction to the relevant local executive body responsible for state architectural and construction control and supervision.;
6) in case of non-fulfillment or improper fulfillment by the contractor (general contractor) of the instructions, inform the customer about this, as well as inform the relevant local executive body responsible for state architectural and construction control and supervision.;
7) to monitor the execution of their instructions entered in the journal of technical supervision;
8) submit the construction project to the relevant local executive body responsible for state architectural and construction control and supervision, as well as the expert opinion on the relevant construction projects.
6. If violations of the requirements of the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities are detected at facilities of all levels of responsibility, an accredited legal entity performing engineering services for technical supervision is held accountable for violations.
At the facilities specified in paragraph 4 of Article 98 of this Code, the person performing engineering services for technical supervision is held liable for violations.
7. At facilities of all levels of responsibility, technical supervision must be carried out by accredited legal entities with at least three employees who have a certificate for the provision of engineering services for technical supervision of the appropriate level of responsibility.
Specialists who have a certificate of technical supervision carry out activities at the facilities specified in paragraph 4 of Article 98 of this Code.
8. When carrying out technical supervision activities, specialists and accredited legal entities are required to own or lease measuring and control equipment, regulatory documentation, and a testing laboratory (center) accredited by right of ownership or engaged.
