Article 576. Conducting procedural actions by video communication CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan
1. Procedural actions at the request of the competent authority of a foreign state are carried out at the location of the person via video communication in the following cases::
1) the impossibility of the arrival of the summoned persons at the competent authority of a foreign state;
2) ensuring the safety of persons;
3) other grounds stipulated by the international treaty of the Republic of Kazakhstan.
2. Procedural actions by video communication are performed in accordance with the procedure provided for by the procedural law of the requesting party to the extent that such procedure does not contradict the principles of the criminal procedure legislation of the Republic of Kazakhstan.
3. The competent authority of the requesting party must ensure the participation of an interpreter during the video conference.
4. If, during the course of the procedural action, a violation of the procedure provided for in part two of this article is detected, the body conducting the process shall inform the participants in the procedural action and suspend it in order to take measures to eliminate the violations. The procedural actions are continued only after the necessary changes in the procedure have been agreed with the competent authority of the requesting party.
5. The protocol of the procedural action and the media of the video information are sent to the competent authority of the requesting party.
6. According to the rules provided for in this article, procedural actions are carried out by video communication at the request of the competent authority of the Republic of Kazakhstan.
