Article 60. The use of special means and physical force The Law on Law Enforcement Service

     1. Employees have the right to use physical force, including combat fighting techniques, as well as special means, including handcuffs, rubber sticks, tear substances, light and sound distracting devices, devices for opening rooms, forcibly stopping vehicles, water cannons, service animals, armored vehicles and other special vehicles, the list of which It is determined by the head of the law enforcement agency in coordination with the central authorized body for budget planning, for:

     1) repelling attacks on individuals, employees, and other persons performing official or public duties to protect public order, ensure public safety, and combat crime;

     2) the release of hostages, the suppression of mass riots and group violations of public order (group violations of the established regime of detention in institutions of the penal system), as well as illegal actions during the escape or detention of convicts, suspects and accused who escaped from correctional institutions and pre-trial detention centers;

     3) repelling attacks on buildings, premises, structures, vehicles, and land plots belonging to individuals, organizations, and government agencies, as well as to free them from seizure;

     4) detaining offenders (convicted, suspected, accused, and persons who have committed administrative offenses) if they disobey or resist officers or other persons performing their duties to protect public order and ensure public safety, for their delivery to law enforcement agencies, escorting and guarding detained or detained persons, as well as persons subjected to administrative arrest, convicted, suspected and accused, or if there are sufficient grounds to believe, that they may escape or cause harm to others or themselves, as well as to persons who intentionally hinder employees in the exercise of their duties assigned to them by law.;

     5) repelling an attack for the purpose of self-defense by an employee or protecting members of his family in the event of a real threat of causing him and (or) them serious harm to health or life.;

     6) necessary defense, extreme necessity;

     7) delivering offenders, if necessary for the purpose of suppressing an offense, establishing the identity of the offender, as well as drawing up a protocol on an administrative offense if it is impossible to draw it up on the spot, if drawing up a protocol is mandatory;

     8) stopping vehicles by damaging them if the driver does not comply with the lawful demands of the employee to stop.

     1-1. Employees have the right to use physical force, including combat fighting techniques, as well as special means in all cases where the use of firearms and other weapons is permitted by this Law.

     1-2. The type of special agent, the start time and the intensity of its use are determined taking into account the current situation, the nature of the offense and the identity of the offender.

     2. It is prohibited to use special means and fighting techniques against women, persons with obvious signs of disability, and minors, except in cases where they commit an attack that threatens the life and health of others, group attacks, or armed resistance.

 

The Law of the Republic of Kazakhstan dated January 6, 2011 No. 380-IV.

     This Law regulates public relations related to admission to the law enforcement service of the Republic of Kazakhstan, its passage and termination, and also defines the legal status (status), financial support and social protection of law enforcement officers of the Republic of Kazakhstan.
