Article 69. Refusal of the defender of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan
1.a witness, suspect, accused, or defendant who has the right to protection has the right to refuse the defense counsel at any time of the proceedings in the case. Such refusal is allowed only on the initiative of a witness, suspect, accused, defendant, who has the right to be protected in the presence of a defender participating in the proceedings in a criminal case or a defender appointed in accordance with the procedure established by part three of Article 67 of this code. It is not accepted to refuse the defender for the reasons of the lack of funds to pay for legal assistance. The refusal is drawn up in writing or reflected in the protocol of the relevant investigative or judicial action.
2.in cases stipulated by paragraphs 2), 3) 4) and 5) of the first part of Article 67 of this code (when a person is suspected of committing crimes for which life imprisonment may be imposed as a punitive measure), paragraph 6) (when forcibly sending a suspect to a stationary forensic psychiatric examination), the body conducting criminal proceedings may not accept the refusal of the suspect, the accused from the defense.
3.refusal of a defense lawyer does not deprive a person of the right to apply for further admission of a defense lawyer to participate in the proceedings in a criminal case. The initiation of a defense attorney into the process does not entail a repetition of actions committed so far in the course of an investigation or trial.
