Article 72. Unified Cadastre of the State Subsoil Fund Code on Subsoil and Subsoil Use Republic of Kazakhstan

    1. The Unified cadastre of the State subsoil Fund contains:

     1) information on the state accounting of minerals, their manifestations and on the objects of the subsurface space;

     2) information about subsurface areas provided for use for geological exploration of subsurface, exploration and (or) extraction of hydrocarbons, solid minerals, common minerals, use of subsurface space, as well as prospecting;

     3) information about liquidated facilities for the extraction of hydrocarbons and solid minerals, common minerals, prospecting, burial of harmful substances, radioactive waste and wastewater discharge into the subsoil;

     4) information on the state registration of existing facilities for the placement of man-made mineral formations.

     2. The state accounting of minerals contains information about mineral deposits, the quantity and quality of the main and associated minerals, the components contained in them, mining, hydrogeological, environmental and other characteristics of a deposit of industrial importance, their location, degree of exploration, degree of industrial development, extraction, losses and provision of industry with minerals, as well as changes in the assessment of mineral resources and reserves for the reporting year as a result of their extraction or revaluation of resources and (or) mineral reserves.

     For each occurrence of minerals, geological and economic data on the projected (prospective) mineral resources, hydrogeological and other characteristics of their occurrence are recorded.

     Information about the objects of the subsurface space includes data on the coordinates of the location and characteristics of the subsurface cavity, the possibility of placing production, economic and other objects and substances in them, and the implementation of technological and other processes in them.

     3. Identification characteristics are recorded for each subsurface area, which make it possible to determine the subsurface area within its spatial boundaries, its size and location, information about the subsurface user, documents on the basis of which the subsurface use right was granted, information about the pledge of the subsurface use right, reports and other documentation provided by the subsurface user, geological information.

     4. Information about liquidated hydrocarbon production facilities, solid minerals, and common minerals includes plans for the location of liquidated production facilities, acts of liquidation, and other data on the elimination of the consequences of mining.

     5. The formation of information in the unified cadastre of the state subsurface fund is ensured by conducting a state geological survey, monitoring of subsurface resources, reporting and other information provided by subsurface users in accordance with this Code.

   6. The provision of information on the state accounting of mineral reserves is determined by the authorized body for the study of mineral resources in accordance with the procedure established by it.

     7. The unified cadastre of the state subsoil fund is maintained in order to take into account the state of the mineral resource base of the Republic of Kazakhstan in accordance with the procedure determined by the authorized body for the study of the subsoil.

     8. The inclusion in the state accounting of minerals of information on the quantity and quality of the main and associated minerals is carried out by the authorized body for the study of the subsoil in accordance with the procedure determined by the Government of the Republic of Kazakhstan, taking into account the provisions of this Code.

     8-1. Accounting for losses in the extraction of solid minerals is carried out on the basis of data on normalized losses provided for by technical projects for the development of deposits, which are an appendix to mining plans.

     The technical projects for the development of deposits specified in part one of this paragraph are subject to approval by the authorized body for the study of subsurface resources in accordance with the procedure determined by it.

     The authorized body for the study of subsurface resources, within fifteen working days after the submission of the technical project for the development of the deposit with data on the estimated losses and supporting documents, has the right to send a reasoned objection to the subsoil user regarding the amount of the estimated losses. If such an objection is sent within the specified period, the normalized losses are determined by the authorized body for the study of subsurface resources independently on the basis of available data on normalized losses for similar projects or based on previously submitted information.

     9. Data on resources and reserves contained in the report on the assessment of resources and (or) reserves of solid minerals, prepared by a competent person in accordance with the Kazakhstan Code of Public Reporting on the Results of Exploration, Mineral Resources and Mineral Reserves (KAZRC Code) and submitted to the authorized body for the study of mineral resources, are subject to inclusion in the state accounting of minerals The fossils are in the following order:

     1) a report on the assessment of resources and (or) reserves of solid minerals submitted to the authorized body for the study of subsurface resources is considered within thirty calendar days.;

     2) within the period specified in subparagraph 1) of this paragraph, the authorized body for the study of subsurface resources must decide on the adoption of a report on the assessment of resources and (or) reserves of solid minerals and the inclusion of resources and (or) reserves of solid minerals in the state accounting of minerals or on the return of the report on the assessment of resources and (or) reserves of solid minerals with a reasoned objection to it;

     3) if, within the period specified in subparagraph 1) of this paragraph, the authorized body has returned a report on the assessment of resources and (or) reserves of solid minerals with a reasoned objection, the applicant for a license to extract solid minerals or the subsurface user has the right to finalize it or appeal the objection of the authorized body for the study of the subsoil in accordance with the legislation of the Republic of Kazakhstan is fine;

     4) if in the resource assessment report and (or) reserves of solid minerals, the amount of resources, taking into account production and losses, has decreased by more than twenty-five percent relative to previously approved reserves of industrial categories, the authorized body for the study of subsurface resources shall conduct a hearing of the subsurface user, competent persons who have prepared and verified the resource assessment report and (or) reserves of solid minerals, It examines the validity of such changes and issues a reasoned conclusion on the acceptance or refusal to accept minerals for state registration. The conclusion of the authorized body for the study of subsurface resources may be appealed by interested parties in accordance with the legislation of the Republic of Kazakhstan.

     The hearing of the subsurface user and the competent persons who have prepared and verified the report on the assessment of resources and (or) reserves of solid minerals is conducted in accordance with the procedure determined by the authorized body for the study of subsurface resources.
