Article 76. General plans of settlements of the Building Code of the Republic of Kazakhstan

Article 76. General plans of settlements of the Building Code of the Republic of Kazakhstan

     1. The development and development of territories of settlements is carried out on the basis of approved general plans of settlements or schemes of development and development of settlements (simplified master plan).

     2. General plans of settlements are the main urban planning document defining the integrated planning of the development of a settlement and developed in accordance with the approved general scheme, the corresponding interregional scheme of territorial development and the integrated scheme of urban planning of territories of regions, districts.

     Settlements with a population of more than five thousand people must be provided with the current general plans of the settlement, approved in accordance with the established procedure.

     Settlements with a population of up to five thousand people may have a scheme for the development and development of a settlement approved in accordance with the established procedure (simplified master plan) as the main urban planning document. The composition, content, procedure for the development and coordination of schemes for the development and development of a settlement (simplified master plan) are determined by the authorized body for architecture, urban planning and construction.

     3. The general plan of the settlement is defined by:

     1) the main directions of development of the territory of the settlement, including social, recreational, industrial, transport and engineering infrastructure, taking into account a comprehensive assessment of the territory, natural, climatic, ecological, prevailing and projected demographic and socio-economic conditions;

     2) functional zoning and restriction of the use of territories;

     3) the ratio of the built-up and undeveloped territories of the settlement;

     4) zones of preferential alienation and acquisition of land plots, reserve territories;

     5) measures to protect the territory from the effects of dangerous (harmful) natural, man-made and anthropogenic phenomena and processes, and to improve the environmental situation;

     6) the main directions for the development of the transport section of the master plan, which includes sections (parts) of documents on territorial transport planning and traffic management;

     7) the main directions of civil defense engineering and technical measures;

     8) technical and economic indicators of the settlement development;

     9) measures to protect water bodies from pollution, clogging, and depletion;

     10) other measures to ensure the sustainable development of the settlement.

     4. When developing and approving the general plan of a settlement, maps of seismic microzoning, as well as maps of mudflow, landslide and avalanche hazards and risks are taken into account.

     5. The general plan of a settlement having historical urban value should be developed taking into account the historical and architectural reference plan and accompanied by projects for a zone of historical development and monument protection.

     6. For cities of national importance, the capital, and regional centers, a concept (master plan) for development is being developed as part of the master plan for settlements.

     The concept (master plan) for the development of the settlement is subject to public discussion and coordination with the relevant maslikhat.

     The formation of a concept (master plan) for the development of a settlement is carried out for a period of up to thirty years.  

     7. The general plan or scheme of development and development (simplified general plan) of a settlement is valid until the approval of a new general plan or scheme of development and development (simplified general plan) of a settlement or approval of changes in the current general plan or scheme of development and development (simplified general plan) of a settlement in a part that does not contradict the legislation of the Republic Kazakhstan.

     8. The general plan of a settlement is adjusted in cases stipulated by the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, amendments and additions to the documents of the State Planning System of the Republic of Kazakhstan in accordance with the rules approved by the authorized body for architecture, urban planning and construction.

     9. Monitoring of the implementation of the general plan of the settlement is carried out by the local executive body once every five years.  

     Based on the monitoring results, a report is generated in the form approved by the authorized body for architecture, Urban Planning and construction, which is posted on the Internet resource of the local executive body and sent for consideration to the architectural and urban planning council and the relevant maslikhat.

     10. General plans of settlements are developed for a period of up to twenty years.  

     11. The composition and volume of the initial materials necessary for the development of general plans of settlements are established by state regulatory documents.

     The initial materials of the general plans of settlements must be entered into the state urban planning cadastre before conducting a comprehensive urban planning examination of urban development projects in accordance with the rules for conducting a comprehensive urban planning examination of urban development projects.
