Article 83. List of grounds for termination of property rights of the State The Law on State Property

     1. The grounds for termination of property rights of the State (the Republic of Kazakhstan or an administrative-territorial unit) are:

     1) privatization and other alienation of state (republican or communal) property;

     2) alienation by state-owned legal entities of goods produced by them or other property not related to fixed assets and not subject to privatization to individuals and non-state legal entities;

     3) provision of land plots to private ownership;

     4) transfer of a state in-kind grant related to republican or communal property to private ownership;

     5) loss or destruction of state property;

     6) foreclosure on state property;

     7) the return of the obligation performed by the counterparty in favor of the state until the termination or amendment of the contract;

     8) the return of the property received under the transaction, declared invalid;

     9) the use or release of material assets from the state material reserve, with the exception of the transfer of material assets of the state material reserve, subject to refreshment, and dispersed material assets when the nomenclature is changed to the balance of other state bodies;

      10) other grounds provided for by the Civil Code of the Republic of Kazakhstan and other laws of the Republic of Kazakhstan.

      2. The alienation of state property is compensatory, except for the cases provided for in Articles 119-1, 119-2, 120 and 214 of this Law and other laws of the Republic of Kazakhstan.

         This Law defines the legal regime of state property, the legal basis for the management of State property, including property assigned to State-owned legal entities, and state-owned shares and stakes in the authorized capital of legal entities, the legal grounds for the acquisition and termination of rights to state property, and is aimed at ensuring the effective exercise by the State of the rights of the owner and holder of other rights. on state property.
