Article 85. Transitional provisions The Law on Special State Bodies of the Republic of Kazakhstan
1. Contracts for military service concluded by employees prior to the enactment of this Law are valid for the periods for which they were concluded.
2. Excluded by the Law of the Republic of Kazakhstan dated December 23, 2023 No. 51-VIII (effective ten calendar days after the date of its first official publication).
3. Employees who were awarded the military rank of "lieutenant Colonel" before November 30, 2011, the term of service in the specified military or special rank is set at five years.
4. Employees who have been transferred from military service to special state bodies in connection with the adoption of this Law and who have changed the age limits for military service by the Law of the Republic of Kazakhstan "On Military Duty and Military Service" have the right to resign or resign upon reaching the following age limits:
1) up to and including a lieutenant colonel – forty-five years;
2) colonels – fifty-three years old;
3) colonels who were awarded military rank before July 21, 2005 – fifty years old;
4) Major generals and lieutenant generals - fifty–eight years old;
5) major generals and lieutenant generals who were awarded military rank before July 21, 2005 - fifty-five years old;
6) Colonel-generals are sixty years old.
4-1. Employees who have been awarded the military ranks of "senior ensign", "ensign", "sergeant major", "sergeant third class", "sergeant second class", "sergeant first class", "staff sergeant" or "master sergeant", serve in special government agencies in accordance with the procedure established by the Legislation of the Russian Federation. and under the conditions stipulated by this Law for the sergeants. At the same time, the maximum age of their status in service in special state bodies is up to forty-seven years inclusive.
4-2. Employees who have been awarded the special rank of lieutenant Colonel from the date of entry into force of this Law until January 1, 2017, have the right to resign or resign upon reaching the age limit of forty–seven years.
5. Employees (except cadets, trainees) are provided with housing until January 1, 2013 in accordance with the procedure provided for military personnel by the Law of the Republic of Kazakhstan "On the Status and Social Protection of military personnel and their family members".
6. Employees provided with official housing or housing equivalent to official housing before January 1, 2013, retain the right to live in this housing, as well as the right to privatize it, provided for by the Law of the Republic of Kazakhstan "On Housing Relations" for military personnel.
7. Paragraph 12 of Article 77 and paragraph 11 of Article 78 of this Law apply, among other things, to persons who, as of January 1, 2022, were widows (widowers) and children of deceased cadets, trainees and staff.

This Law defines the status of special state bodies of the Republic of Kazakhstan (hereinafter referred to as special state bodies), regulates public relations related to admission to service in special state bodies, its passage and termination, and also defines the legal status, financial support and social protection of employees of special state bodies.
