Article 851-1. Grounds for the review of court rulings on administrative offences that have entered into force by the Supreme Court of the Republic of Kazakhstan The Code of the Republic of Kazakhstan on Administrative Offences

1. The Supreme Court of the Republic of Kazakhstan may, in exceptional cases, review judicial acts that have entered into force after their consideration in the cassation instance upon the recommendation of a judge of the Supreme Court of the Republic of Kazakhstan or a protest by the Prosecutor General of the Republic of Kazakhstan, if:

1) the adopted resolution violates the uniformity in the interpretation and application of legal norms by courts, authorized bodies (officials);

2) the adopted resolution violates the rights and legitimate interests of an indefinite circle of persons or other public interests;

3) the execution of the adopted resolution may lead to serious irreversible consequences for the life, health of people or for the economy and national security of the Republic of Kazakhstan.

2. The Prosecutor General of the Republic of Kazakhstan has the right to file a protest for review in the Supreme Court of the Republic of Kazakhstan of judicial acts that have entered into force, both on his own initiative and at the request of the persons specified in part four of Article 851 of this Code, on the grounds provided for in part one of this Article.
