Article 9. The exclusive right to a topology created in the course of performing official duties and under an agreement with the customer of the Law on the Legal Protection of Integrated Circuit Topologies

1. The exclusive right to a topology created in the course of fulfilling official duties or a specific task of the employer belongs to the employer, unless the contract between him and the author provides otherwise.

2. The amount, conditions and procedure for payment of remuneration to the author for the topology specified in paragraph 1 of this article are determined by an agreement between the author and the employer. If it is impossible to balance the contribution of the author and the employer to the creation of the topology, the amount, conditions and procedure for paying remuneration to the author are determined by legislative acts of the Republic of Kazakhstan.

3. The author may contractually undertake to create a topology and grant the customer, who is not his employer, exclusive rights to the topology.
