Article 94. Separate detention of convicted persons in institutions criminal Executive Code of the Republic of Kazakhstan
1.separate detention of convicted men and women, minors and adults is established in institutions.
2.persons convicted for the first time of deprivation of liberty are personally detained from convicts who have already served imprisonment, with the exception of the persons referred to in part five of this article. This article does not apply to institutions with the lowest possible security.
Women who have been sentenced to imprisonment for the first time in one institution and have been serving this sentence for a long time, including former employees of courts, law enforcement agencies and special state bodies, persons authorized to exercise control and supervision over the behavior of convicts, can be kept separately.
In isolation from other convicts, as well as separately: convicted in the event of dangerous recidivism of crimes; sentenced to life imprisonment; sentenced to life imprisonment transferred to imprisonment for a certain period in the order of pardon.
3.in individual institutions, regardless of the number of convictions, convicted persons – former employees of courts, law enforcement agencies and special state bodies, persons authorized to exercise control and supervision over the behavior of convicted persons are detained.
If it is not possible to personally detain convicted women – former employees of courts, law enforcement agencies and special state bodies, persons authorized to exercise control and supervision over the behavior of convicts, they may be detained separately from other convicts in institutions.
The power of this part does not apply to institutions with the lowest possible security.
4.the requirements established by this article for the separation of convicted persons shall not apply to institutions where there is an orphanage.
5.convicts suffering from various infectious diseases are kept separately and separately from healthy convicts. In medical and preventive institutions (hospitals, specialized psychiatric and TB hospitals), convicted men are kept together, regardless of the type of regime determined by the court. Separate detention of convicts in antitubercular hospitals is determined by medical indications.
