Article 97. The name, patronymic and surname of the adopted child of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. An adopted child may retain his/her first name, patronymic (if any), and last name.
2. At the request of the adoptive parent, the adopted child is assigned the surname of the adoptive parent, as well as the name indicated by him, if this does not contradict the interests of the child. The patronymic of an adopted child is determined by the name of the adopter if the adopter is a man, and when the child is adopted by an unmarried woman, - by the name of the person indicated by her as the father of the adopted child in accordance with Article 192 of this Code.
If the surnames of the adoptive parents are different, by agreement of the adoptive parents, the adopted child is assigned the surname of one of them.
3. When a child is adopted by an unmarried person, at his request, the name, patronymic and surname of the father (mother) of the adopted child are recorded in the record of the state registration of birth at the direction of the adoptive parent. At the request of the adoptive parent, information about the father (mother) may not be indicated.
The surname of the father (mother), indicated at the request of the adoptive parent, is assigned according to the surname of the adoptive parent.
4. The name, patronymic and surname of an adopted child who has reached the age of ten may be changed only with his consent, except in cases requiring secrecy of adoption.
5. The change in the name, patronymic and surname of the adopted child is indicated in the court decision on his adoption.
6. Amendments and additions to the record of the state registration of birth are made at any registration authority on the basis of a court decision on adoption that has entered into force and an application from the child's legal representatives.
Information about the child and the adoptive parents is entered in the record of the state registration of the birth in accordance with the information specified in the court decision.
