Article 99. Competence of the authorized body for entrepreneurship in the field of state support and development of private entrepreneurship of the Entrepreneurial Code of the Republic of Kazakhstan

Authorized Body for Entrepreneurship:

1) performs strategic, regulatory and implementation functions within its competence;

1-1) on the basis of and in pursuance of the main directions of the domestic and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, forms a state policy in the field of state support and development of private entrepreneurship in accordance with the legislation of the Republic of Kazakhstan;

2) organizes and coordinates the implementation of state measures to support and develop small and medium-sized businesses;

2-1) Approves the rules for granting property lease (lease) or trust management to small and medium-sized businesses of unused state-owned objects and land plots occupied by them for the organization of production activities and the development of services to the public, followed by gratuitous transfer to ownership;

2-2) organizes the consideration by expert councils of draft regulatory legal acts developed by central state, local representative and executive bodies, draft international treaties of the Republic of Kazakhstan, as well as international treaties to which the Republic of Kazakhstan intends to become a party, affecting the interests of private business entities;

2-3) conducts an analysis of the functioning of economic sectors in order to eliminate obstacles to the development of private business entities;

2-4) organizes the provision of economic information on the state of domestic and foreign markets to private business entities;

2-5) approves the rules for the accreditation of associations of private business entities; - Excluded by the Law of the Republic of Kazakhstan dated July 17, 2025 No. 213-VIII SAM

2-6) develops and approves a register of state support measures for private entrepreneurship;

2-7) develops and approves the rules for the formation, maintenance and updating of the register of state support measures for private entrepreneurship;

2-8) develops and approves a standard form for measures of state support for private entrepreneurship;

 3) analyzes the effectiveness of state support measures for private entrepreneurship and develops proposals for their improvement;

4) conducts an analysis of the business environment, investment climate and infrastructure for the development of private entrepreneurship;

5) develops and approves regulatory legal acts in the field of state support and development of private entrepreneurship in accordance with the objectives of this Code and the legislation of the Republic of Kazakhstan;

6) promotes the formation and development of the infrastructure of small and medium-sized enterprises in the regions of the republic;

7) creates conditions for the participation of small and medium-sized enterprises in the implementation of documents of the State Planning System of the Republic of Kazakhstan in the field of innovative, investment and industrial development;

8) creates conditions for investors and international grant-giving organizations in matters of support and development of private entrepreneurship;

9) organizes methodological assistance to private business entities;

9-1) develops and approves a methodology for developing a Digital Business Map;

10) creates conditions for private business entities to enter international markets for goods, works, and services;

11) carries out international cooperation in the field of private enterprise development;

12) promotes government policy on the development and support of private entrepreneurship;

13) exercise other powers provided for by this Code, the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
