Commentary to article 456. Grounds for revocation or amendment of the verdict, decisions of the appellate instance The Criminal Procedure Code of the Republic of Kazakhstan
The grounds for the cancellation or amendment of the verdict, the decisions of the appellate instance are:
1) incorrect application of the criminal law;
2) a significant violation of the Criminal procedure law;
3) the injustice of the sentence.
The current Code of Criminal Procedure provides for an exhaustive list of grounds for revoking or changing a verdict or a decision of an appellate court.
Similarly, the same grounds for cancellation and amendment should be applied to verdicts and rulings of the court of first instance.
