On the ratification of the Agreement between the Republic of Kazakhstan and Mongolia on the settlement of issues of voluntary resettlement and citizenship of persons who arrived in the Republic of Kazakhstan under employment contracts

In accordance with Article 2 of the Law of the Republic of Kazakhstan dated December 10, 1993 Z933600_ "On temporary delegation of additional powers to the President of the Republic of Kazakhstan and heads of local administrations"
I decree:
1. To ratify the Agreement between the Republic of Kazakhstan and Mongolia on the settlement of issues of voluntary resettlement and citizenship of persons who arrived in the Republic of Kazakhstan under employment contracts, signed in Almaty on December 2, 1994.
2. This Decree shall enter into force from the date of publication. Guided by the provisions of the Treaty on Friendly Relations and Cooperation between the Republic of Kazakhstan and Mongolia dated October 22, 1993 B941200_ ,
We have agreed on the following:
Article 1 In this Agreement, the term "persons who arrived in the Republic of Kazakhstan under employment contracts" means citizens of Mongolia who work under employment contracts, as well as family members accompanying them, within the framework of the "Agreement between the Ministry of Labor of the Kazakh SSR and the Ministry of Labor of the MNR on cooperation in the field of labor market, employment and social protection of the population" from September 21, 1991, and the "Agreement between the Ministry of Labor of the Republic of Kazakhstan and the Ministry of Labor of Mongolia on cooperation in the field of labor market and regulation of migration processes" dated June 30, 1992, and the term "displaced persons" means persons who voluntarily renounced the citizenship of Mongolia and leave for the Republic of Kazakhstan for permanent residence with the desire to become its citizens.
Article 2 This Agreement will regulate the issues of citizenship of persons who arrived in the Republic of Kazakhstan under employment contracts before 1994 and migrants, as well as other issues related to them.
Article 3 The Parties have agreed that the issue of citizenship of persons who arrived in the Republic of Kazakhstan under employment contracts will be resolved solely on the basis of their free and voluntary expression of will in accordance with the national laws of the Parties and generally recognized principles of international law.
Article 4 The Kazakh Side, from the date of receipt by its competent authority of official notifications from the Mongolian Side on the satisfaction of written requests from persons who arrived in the Republic of Kazakhstan under employment contracts to renounce the citizenship of Mongolia and accept the citizenship of the Republic of Kazakhstan, will accept them into its citizenship.
Article 5 The Parties agreed that the issue of renunciation of Mongolian citizenship by the migrants should be resolved in accordance with Mongolian law before their final departure to the Republic of Kazakhstan.
Article 6 The annual number of displaced persons is agreed upon between the competent authorities of the Parties, based on the actual number of people willing to relocate and on the logistical and other capabilities of the host Country.
Article 7 The competent authorities of the Parties, in order to avoid prejudice to the rights and interests of persons who arrived in the Republic of Kazakhstan under employment contracts, during their voluntary expression of their will regarding renunciation of their citizenship and adoption of a new citizenship, will carry out the necessary control measures locally in the form agreed between them.
Article 8 The Kazakh Side fully covers the transportation costs of displaced persons, and it undertakes to create the necessary social and living conditions, including housing and cash benefits for displaced persons, to provide them with the opportunity to freely choose a place of permanent residence in the territory of the Republic of Kazakhstan, to employ them in specialties and professions, and to assist in obtaining education, acquiring new specialties, retraining and retraining.
Article 9 The Parties undertake to freely pass through and not impose any customs taxes, duties and other charges on the property owned by the displaced persons, including livestock, with the exception of elite and first-class breeding animals. The Kazakh Side guarantees the preservation of the ownership rights of displaced persons to transported property, including livestock.
Article 10 The provisions of this Agreement will apply to family members of mixed marriages.
Article 11 The issue of the restoration of their citizenship by the displaced persons will be resolved in accordance with the legislation of Mongolia.
Article 12 This Agreement may be amended and supplemented by agreement of the Parties.
Article 13 This Treaty is subject to ratification in accordance with the domestic legislation of the Parties.
This Treaty has been concluded for a period of five years and will enter into force on the date of the exchange of instruments of ratification.
Done in Almaty on December 2, 1994, in two originals, each in the Kazakh, Mongolian and Russian languages, all texts being equally authentic.
In case of disagreement on the text of this Agreement, its interpretation will be carried out in accordance with the text in Russian.
