Article 1006. Conditions for the protection of rights to new plant varieties and new animal breeds of the Civil Code of the Republic of Kazakhstan
1. The rights to new plant varieties and new animal breeds (breeding achievements) are protected subject to the grant of a patent. The patent certifies the exclusive right of the patent holder to use the breeding achievement, its priority and the authorship of the breeder.
A plant variety obtained artificially or by selection and having one or more economic characteristics that distinguish it from existing plant varieties is recognized as a breeding achievement in crop production.
A breeding achievement in animal husbandry is recognized as a breed, that is, an integral numerous group of animals of common origin, created by man and having a genealogical structure and properties that make it possible to distinguish it from other breeds of animals of the same species and are quantitatively sufficient for reproduction as a single breed.
2. The conditions of legal protection of breeding achievements, the procedure for registration and issuance of patents for plant varieties and animal breeds are established by legislative acts.
3. The rules of Articles 992-998, 1000-1004 of this Code shall apply to relations related to the rights to breeding achievements and the protection of these rights, unless otherwise provided by the rules of this chapter and legislative acts on the protection of breeding achievements.
