Article 259. Keeping and breeding in captivity and (or) semi-captive conditions of rare and endangered species of animals, as well as species included in the annexes of the Convention on International Trade in Endangered Species of Wild Fauna and Flora of the Environmental Code of the Republic of Kazakhstan
1. Artificial breeding of rare and endangered species of animals, as well as species included in the annexes of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, may be in captivity (cage and aviary) or semi-captive conditions (keeping in parks and other areas with conditions close to natural habitat).
2. The keeping and breeding in captivity and (or) semi-captivity of rare and endangered species of animals, as well as species included in the annexes to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, are permitted to individuals and legal entities provided they comply with the following requirements:
1) the availability of conditions for keeping animals, including a site or premises designated in accordance with the established procedure, equipped with aviaries, cages and other facilities;
2) implementation of zootechnical, veterinary and sanitary-epidemiological measures to the required extent;
3) availability of zoological, zootechnical and veterinary specialists, and other persons with skills in keeping animals in captivity or semi-captivity;
4) the availability of a permit from an authorized state body in the field of protection, reproduction and use of wildlife or an authorized body in the field of fisheries.
3. Permits for captive and/or semi-captive breeding of rare and endangered species of animals, as well as species included in the annexes to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, specify the mandatory requirements, as well as the maximum number of individuals by animal species. If individuals and legal entities do not comply with the conditions of the permit, the permit may be revoked or revoked after two warnings within six months.
4. Rare and endangered animal species are kept and bred in captivity and/or semi-captivity in specialized zoological nurseries in accordance with the regulations on these nurseries.
5. Owners of animals classified as rare and endangered species, as well as species included in the annexes to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, and Kept in captivity and/or Semi-captivity, are required to permanently ring or label these animals and have passports for them..
6. Individuals and legal entities that keep animals classified as rare and endangered species in captivity and (or) semi-captive conditions have the right to purchase, sell and exchange these animals within the Republic of Kazakhstan only with the permission of the authorized state body in the field of protection, reproduction and use of wildlife or an authorized body. the authority in the field of fisheries within their competence.
7. Individuals and legal entities that own animals classified as rare and endangered species, as well as species included in the annexes to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, Kept in Captivity and (or) Semi-captive Conditions, may use them for international trade purposes. in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
8. If international trade in rare and endangered species of animals bred in captivity and (or) semi-captive conditions may cause environmental and (or) economic damage to the State, the Government of the Republic of Kazakhstan has the right to impose restrictions on such trade.
