Article 339. Illegal handling of rare and endangered, as well as prohibited species of plants or animals, their parts or derivatives, Criminal Code of the Republic of Kazakhstan

1. illegal capture, possession, storage, sale, import, export, shipment, transportation or destruction of rare and endangered species of plants or animals, including those whose circulation is regulated by international treaties of the Republic of Kazakhstan, as well as plants or animals, their parts or derivatives prohibited for use, as well as destruction of their habitats –

with confiscation of property and deprivation of the right to hold certain positions or engage in certain activities for a period of up to five years, it is punishable by a fine of up to three thousand monthly calculation indices, or involvement in correctional labor in the same amount, or in public works for a period of up to eight hundred hours, or restriction of freedom for a period of up to three years, or imprisonment for the same period.

1-1. illegal capture, destruction of a deer, as well as possession, storage, sale, importation, export, shipment, transportation of an illegally captured deer –

with confiscation of property, deprivation of the right to hold certain positions or engage in certain activities for a period of up to five years, the restriction of freedom for a period of three to five years or imprisonment for the same period is punishable.

2. provided for in the first or parts 1-1 of this article, the following:

1) made several times;

2) a group of people, committed by a group of people by prior collusion;

3) made in specially protected natural areas;

4) made by a person using his official position;

5) actions committed with the infliction of significant damage –

with confiscation of property and deprivation of the right to hold certain positions or engage in certain activities for a period of up to five years, it is punishable by a fine in the amount of three to seven thousand monthly calculation indices, or correctional labor in the same amount, or restriction of freedom for a period of three to seven years, or imprisonment for the same period.

3. provided for in the first, 1-1 or second parts of this article, the following documents shall be submitted::

1) committed by a criminal group;

2) actions committed with the infliction of particularly large damage –

with confiscation of property and deprivation of the right to hold certain positions or engage in certain activities for a period of up to five years, is punishable by imprisonment for a period of seven to twelve years.
