Article 242. State registration of the dissolution of a marriage (matrimony) with a person recognized as missing, incapacitated or sentenced to a long term of imprisonment of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
In the case of state registration of the dissolution of a marriage (matrimony) with a person recognized as missing, incapacitated or sentenced to imprisonment for a term of at least three years for committing a crime, the registering authority, a foreign institution of the Republic of Kazakhstan are obliged to notify the imprisoned spouse or the guardian of the incapacitated spouse or the guardian of the property of the recognized missing spouse with the establishment of a forty-five-day period from the date of receipt of the notification, during which they have the right to inform in writing about the existence of a dispute between them on the application for the dissolution of marriage (matrimony).
The absence of a response within the prescribed time, the refusal to terminate the marriage (matrimony) are not obstacles to the dissolution of the marriage (matrimony).
