Article 16. Inviolability of private life CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. The right to privacy, personal and family secrets, and protection of personal data from illegal collection, processing, storage, and use, including through the use of digital technologies, is guaranteed by law.
Everyone has the right to secrecy of banking transactions, personal deposits and savings, correspondence, telephone conversations, postal and other messages transmitted by means of communication, including using digital technologies.
2. When conducting criminal proceedings, everyone is guaranteed the right to inviolability of private (personal and family) life. Limitation of this right is allowed only in cases and in accordance with the procedure directly established by law.
3. No one has the right to collect, store, use and disseminate information about a person's private life without his consent, except in cases stipulated by law.
4. Information about a person's private life obtained in accordance with the procedure provided for by this Code may not be used except to fulfill the tasks of the criminal process.
