Article 19-1. Measures for the individual prevention of delinquency, neglect and homelessness among minors of the Law on the Prevention of Delinquency among Minors and the Prevention of Child Neglect and Homelessness
1. Measures of individual prevention of offenses, neglect and homelessness among minors are applied for systematic targeted impact on the legal awareness and behavior of minors in order to prevent the commission of new offenses on their part, as well as to eliminate the causes and conditions conducive to their commission.
2. Measures of individual prevention of offenses, neglect and homelessness among minors are:
1) preventive conversation;
2) the idea of eliminating the causes and conditions that contribute to the commission of offenses;
3) preventive accounting and control;
4) referral to special educational institutions and educational institutions with special conditions of detention;
5) measures of educational influence;
6) Protective order;
7) administrative penalty;
8) measures taken by court verdict;
9) medical and social accounting.
3. Measures for the individual prevention of offences, neglect and homelessness among minors shall be determined taking into account the individual characteristics of the minors to whom they apply, the nature and degree of public danger of the offences committed by them.
4. The decision on the application of measures for the individual prevention of offenses, neglect and homelessness among minors may be appealed by interested persons in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
5. Measures of individual prevention of offenses against minors who have committed domestic violence are applied taking into account the specifics established by the legislation of the Republic of Kazakhstan on the prevention of domestic violence.
6. Consideration of measures for the individual prevention of offenses, neglect and homelessness among minors is carried out in accordance with the procedure determined by the central executive bodies within their competence.
The Law of the Republic of Kazakhstan dated July 9, 2004 No. 591.
This Law defines the legal, economic and social foundations of the activities of State bodies for the prevention of juvenile delinquency and the prevention of child neglect and homelessness.
