Commentary to article 72. The period during which a minor is considered to have been subjected to an administrative penalty The Code of the Republic of Kazakhstan on Administrative Offences
A minor who has been subjected to an administrative penalty for an administrative offense is considered to have been subjected to this penalty within six months from the date of the end of the execution of the decision on the imposition of an administrative penalty.
The provisions fixed in the disposition of this norm generally repeat the provisions fixed in art. 61 of the Administrative Code "The period during which a person is considered to be subjected to administrative punishment", with the difference in a special subject – a minor, in a special period.
Thus, this rule applies only to minors between the ages of 14 and 18 who have committed an administrative offense and have been subjected to administrative punishment.
Another feature of this rule is the time limit. If, according to the general rule (art. 61 of the Administrative Code), the term is set at 1 year from the date of execution of the administrative penalty, then for minors it is half as long as 6 months.
This situation is caused by the position of the legislator, according to which the commission of an administrative offense refers to circumstances mitigating responsibility for an administrative offense, in accordance with paragraphs 4), part 1, art. 56 of the Administrative Code.
The reduction of time limits for minors who have committed an offense is a general trend in legislation and is also reflected in the setting of time limits by criminal law (art. 88 of the Criminal Code).
