Article 239. Evaluation and use of the results of covert investigative actions in proving the CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan

Article 239. Evaluation and use of the results of covert investigative actions in proving the CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan

     1. The results of covert investigative actions are evaluated according to the rules provided for in Articles 25 and 125 of this Code.

     2. Protocols of the investigation of the results of secret investigative actions, sound recordings and recordings of images, photographs, other results recorded by scientific and technical means, seized objects and documents or their copies are used in evidence along with evidence obtained as a result of investigative actions.

     3. If secretly recorded statements or actions of a person are used in evidence, this person must necessarily be questioned about it. Upon familiarization of a person with factual data obtained without his knowledge, this person is informed about the covert action to the extent that they directly affect the relevant person and exclude the disclosure of state secrets and other legally protected secrets.
