Article 561. Storage and transfer of material evidence CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. The material evidence transferred by the requested party in the order of execution of the request (instructions, petitions) of the competent authority of the Republic of Kazakhstan shall be stored in accordance with the procedure established by this Code, and after the completion of the criminal proceedings shall be returned to the requested party, unless otherwise agreed.

     2. During the transfer of material evidence to the competent authority of the requesting party in the order of execution of the request (order, petition), the competent authority of the Republic of Kazakhstan may waive the requirement to return them to the Republic of Kazakhstan after the end of criminal proceedings from the requesting party in the case of, if there is no need for their use in the territory of the Republic of Kazakhstan for pre-trial investigation and judicial proceedings in other criminal proceedings, or legitimate claims of third parties regarding the right to the relevant property or a dispute regarding it are considered in court.
