Article 26. Cases of exemption from liability for the dissemination of information that does not correspond to the validity of the Law on Mass Media

     The mass media, as well as its editor-in-chief (editor), the journalist are not responsible for the dissemination of information in the media that does not correspond to reality, if they:  

     1) were contained in official communications;

     2) are contained in the response to the request of the media or obtained from the materials of the authorized person (department) for interaction with the media;

     3) received from advertisers and advertising producers;

     4) are verbatim reproductions of official speeches of deputies of representative bodies, officials or authorized persons of state bodies, local self-government bodies, individuals and legal entities, with the exception of the dissemination of information prohibited or otherwise restricted for dissemination by judicial acts or laws of the Republic of Kazakhstan that have entered into force.;  

     5) were contained in author's speeches broadcast without prior recording, or texts that are not subject to editing in accordance with this Law;  

     6) were contained in messages, materials or fragments thereof distributed by another media outlet registered with an authorized body, provided that the message contains a reference to the media outlet that disseminated the message, with the exception of the dissemination of information prohibited or otherwise restricted by judicial acts or laws that have entered into force.      7) were contained in mandatory communications established in accordance with Article 18-2 of this Law.

 

 

The Law of the Republic of Kazakhstan dated July 23, 1999 No. 451-I.

      This Law regulates public relations in the field of mass media, establishes state guarantees of their freedom in accordance with the Constitution of the Republic of Kazakhstan.
