Article 265. Issuance of a mining license Code on Subsoil and Subsoil Use Republic of Kazakhstan
1. A person interested in obtaining a mining license shall submit a written application to the local executive body of the region in a form approved by the authorized body in the field of solid minerals.
2. The application must contain the following information:
1) the surname, first name, patronymic (if it is indicated in the identity document) of the applicant, place of residence, information about the applicant's identity documents;
2) an indication of the territory defining the mining area that the applicant requests to be provided for use, on a scale with geographical coordinates of corner points and an indication of the total area.
3. The following documents are attached to the application:
1) copies of documents confirming the information provided for in subparagraph 1) paragraph 2 of this article;
2) excluded by the Law of the Republic of Kazakhstan dated 01/02/2021 No. 401-VI (effective from 03/01/2021);
3) a document confirming the authority of the person acting on behalf of the applicant when submitting the application, if such person is appointed by the applicant;
4) a document approved by the applicant and containing a list of mechanization tools and equipment that are planned to be used in prospecting, as well as a description of the types and methods of prospecting work that is planned to be carried out at the prospecting site;
5) the consent of the land user or the private owner of the land plot, as well as the user of the subsurface area on the territory of which the application is submitted in accordance with this paragraph;
6) a prospecting plan, if the applicant intends to use the means of mechanization during the first year of the prospecting license.
4. Copies of the documents attached to the application must be notarized.
5. The application and the documents attached to it must be written in Kazakh and Russian.
6. The time of filing the application is determined by the date and time of receipt of the application to the local executive body of the region and is subject to accounting.
7. Information about the submitted application is posted on the unified subsurface use platform on the day of application submission and contains:
1) the surname, first name and patronymic (if it is indicated in the identity document) of the applicant;
2) coordinates of the territory of the mining site, which the applicant requests to be provided for use;
3) the date and time of receipt of the application.
8. The local executive body of the region considers the application within seven working days from the date of its receipt and issues a license or refuses to issue it.
9. A person who has received a prospecting license is obliged to pay a subscription bonus in the amount, in the manner and within the time limits provided for by the tax legislation of the Republic of Kazakhstan.
10. The procedure for submitting and reviewing applications for mining licenses is determined by the authorized body in the field of solid minerals.
