Article 306. Criminal cases within the jurisdiction of the district and equivalent courts of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. District and equivalent courts shall act as a court of first instance.

     2. The district court and its equivalent court have jurisdiction over all criminal cases, with the exception of criminal cases referred to the jurisdiction of specialized courts, unless their jurisdiction has been changed in the cases provided for by this Code.

     3. At the pre-trial stage of criminal proceedings, specialized investigative courts and specialized inter-district investigative courts consider complaints against decisions and actions (inaction) of persons conducting pre-trial investigations, the prosecutor overseeing the legality of operational investigative activities, pre-trial investigations, authorize procedural actions in cases provided for by this Code, and also exercise other powers provided for by this Code. The Code.

     4. During the execution of the sentence, the district and equivalent courts consider the issues referred to in Articles 475 and 476 of this Code in cases referred to their jurisdiction.

     5. In the cases provided for by this Code, district and equivalent courts in cases referred to their jurisdiction shall consider petitions for the initiation of proceedings on newly discovered circumstances.

     Note. If specialized investigative courts have not been established on the territory of the relevant administrative-territorial unit, specialized interdistrict investigative courts, the materials assigned to their jurisdiction may be considered by district and equivalent courts (the investigating judge), with the exception of cases provided for in Articles 232, 234, 240 of this Code. The investigating judge (judges) of the district and equivalent courts are appointed (appointed) from among the judges by the chairman of this court. If it is necessary to replace the investigating judge, he may be reassigned.
