Article 414. The right to file an appeal (private) complaint, to bring a prosecutor's petition against sentences, resolutions of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. The right to appeal a verdict or decision belongs to the convicted person, the acquitted person, their defenders, including those who entered into proceedings after the verdict or decision was announced, their legal representatives, the victim (private prosecutor), their representatives and legal representatives. The civil plaintiff, the civil defendant, their representatives and legal representatives have the right to appeal the verdict in the part relating to the civil claim.
2. The appeal petition of the prosecutor for the review of the judicial act on appeal may be brought by the prosecutor who participated in the consideration of the case as a public prosecutor. The Prosecutor General of the Republic of Kazakhstan and his deputies, the Chief Military Prosecutor, the Chief Transport Prosecutor, regional prosecutors and equivalent prosecutors and their deputies, military prosecutors of regions and garrisons, regional transport prosecutors, district prosecutors and equivalent prosecutors may, within the limits of their competence, file an appeal petition of the prosecutor for a review of the verdict, resolution independently from participating in the consideration of the case.
3. Persons who are not parties to the case may also appeal a judicial act if the decision concerns their rights and legitimate interests.
