Commentary to article 506. A court decision issued following the consideration of a prosecutor's petition for a review of judicial acts based on newly discovered circumstances The Criminal Procedure Code of the Republic of Kazakhstan
Having considered the prosecutor's request to resume proceedings on the case due to newly discovered circumstances, the court issues one of the following decisions on:
1) the satisfaction of the petition and the annulment of the verdict or court order and the transfer of the case for investigation or a new trial;
2) satisfaction of the petition and cancellation of the verdict or court order and termination of the case, when an investigation or court proceedings are not required to make a final decision on the case.;
3) rejection of the application.
This article lists the types of court decisions issued following consideration of the prosecutor's request for judicial review based on newly discovered circumstances. These rulings are the same in content as the rulings that the court makes following the consideration of petitions from other persons specified in the first part of Article 502 of the CPC.
