Article 47. State Registration of Rights (Encumbrances of Rights) to Immovable Property in Bankruptcy Proceedings of the Law on State Registration of Rights to Immovable Property
1. The transfer of the right to manage the debtor's property to a rehabilitation or bankruptcy administrator is subject to state registration in the legal cadastre in accordance with the procedure provided for in Article 21 of this Law.
2. In cases where the debtor's rights to immovable property have not been registered, the persons to whom the right to manage the debtor's property and affairs has been transferred also have the right to register the rights to immovable property and apply for registration on the basis of transactions concluded (signed) by the debtor prior to the introduction of bankruptcy proceedings and other title documents..
The refusal of these persons to file an application for registration on the basis of transactions signed by the debtor prior to the introduction of bankruptcy proceedings may be challenged by interested parties in court.
