Article 16. Debtor's application for the application of the out-of-court bankruptcy procedure The Law on the Restoration of Solvency and Bankruptcy of Citizens of the Republic of Kazakhstan
1. The debtor submits an application for the application of the out-of-court bankruptcy procedure in the prescribed form through the Government for Citizens State Corporation, the e-Government web portal and (or) a special mobile application.
2. Excluded by the Law of the Republic of Kazakhstan dated 06/19/2024 No. 97-VIII (effective sixty calendar days after the date of its first official publication).
3. If the debtor complies with the circumstances provided for in Article 5 of this Law and the spouse agrees (if any) by the authorized body, information about the debtor is posted on the e-government web portal within fifteen working days.
4. If the debtor does not comply with the circumstances provided for in Article 5 of this Law and the spouse does not agree (if any), the authorized body shall send a notification of refusal to apply the out-of-court bankruptcy procedure within fifteen working days in the form established by the authorized body.
5. The debtor has the right to file a repeated application for the application of the out-of-court bankruptcy procedure after the exclusion of the grounds that caused the refusal to apply the out-of-court bankruptcy procedure, but not earlier than three months after the date of receipt of the refusal.
This Law regulates public relations arising in the event of the insolvency of a citizen of the Republic of Kazakhstan, establishes the grounds for the application of the procedure for restoring solvency, as well as the procedures for out-of-court and judicial bankruptcy, the procedure and conditions for their conduct.
