Article 475. Postponement, extension of the sentence execution Criminal Procedure Code of the Republic of Kazakhstan of the Criminal Procedure Code of the Republic of Kazakhstan

    1. execution of a sentence on conviction of a person for involvement in public works, correctional labor, restriction of his liberty or deprivation of his liberty in the presence of one of the following grounds:

     1) a convicted person has a serious illness that prevents him from serving a sentence – until his recovery;

     2) the convicted woman is pregnant, the convicted woman has a young child or is raising him, and in relation to a man raising a young child alone – in accordance with the procedure provided for in Article 74 of the Criminal Code of the Republic of Kazakhstan;

     3) immediate serving of a sentence for a convicted person or his family – may be postponed for a period established by the court, but not more than six months, and for a period not exceeding three months in respect of persons specified in the second part of Article 76 of the Criminal Code of the Republic of Kazakhstan, if it may entail serious consequences as a result of a fire or other natural disaster, serious illness or death of the only able-bodied family member or other emergency situations.

     2.payment of a fine, other amounts to be collected from a convicted person by a court verdict, may be postponed or extended for a period of up to one year, if its immediate payment is not possible for the convicted person.

     3.if the court has not resolved the issue of postponing the execution of the sentence at the time of sentencing, it shall be resolved by the court that issued the sentence or the court in the service district, where the sentence is brought to execution, at the request of the convicted person, his legal representative, close relatives, defense attorney, or on the recommendation of the prosecutor or the body charged with executing the sentence.

     Postponement of execution of the sentence in terms of additional punishment is not allowed.
