Article 49. Compliance with and extension of the CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan
1. The deadline shall not be considered missed if the complaint, petition or other document is submitted to the post office before the deadline, transferred or submitted to the person authorized to receive them, and for persons in custody or placed in a medical organization – if the complaint or other document is submitted before the deadline to the administration of the place of detention or medical organizations. The time of delivery of a complaint or other document to the post is determined by the postmark, and the time of delivery to the person authorized to receive them, or to the administration of the place of detention or a medical organization, is determined by the mark of the office or officials of these organizations.
2. Compliance with the established deadline by officials is confirmed by an appropriate indication in the procedural documents. Receipt of documents to be served to persons involved in criminal proceedings is confirmed by their receipt attached to the case.
3. The procedural time limits may be extended only in the cases and in accordance with the procedure established by this Code.
