 Article 72. Private prosecutor CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. A private prosecutor is a person who has filed a complaint with the court in a private prosecution case and supports the prosecution in court, as well as a victim in public and private-public prosecution cases who independently supports the prosecution in court, if the public prosecutor refuses to charge.

     2. In the case of a minor or incapacity of the victim, the private prosecutor is considered to be his legal representative, who filed a petition, request or filed a complaint.

     3. A private prosecutor shall enjoy all the rights and bear all the duties of a victim, as well as be endowed with the rights provided for in parts three and five of Article 411 of this Code.

     4. The private prosecutor shall enjoy the rights belonging to him and perform the duties assigned to him personally or, if this corresponds to the nature of the rights and duties, through a representative.
