Article 52. Aircraft charter of the Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities

     1. The charter of an aircraft is carried out in accordance with the charter agreement.

     The charter agreement specifies the names of the parties, the type of aircraft, the purpose of the lease, the maximum number of passengers carried, the weight of baggage, cargo and mail, the amount of freight, departure point, time and destination of transportation.

     The charter agreement may also include other conditions.

     2. The charterer has the right, without requiring additional payment from the charterer, to postpone the start time of transportation and the time of takeoff of the aircraft at the landing sites provided for in the flight plan, to make additional landings or change the flight route if necessary to ensure the safety of the aircraft flight.

     3. The charterer is obliged to transfer the entire capacity of the aircraft in a timely manner and, during the validity of the contract, to maintain the aircraft in such a condition that it can be used for the purposes provided for in the contract.

     4. The charterer has the right, with the consent of the charterer, to transfer the chartered aircraft to a subcharter.

     This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
